Federal Judge Mandates Freedom of Abrego Garcia from Immigration Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her decision, the judge pointed out that the government lacks a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Background of the Legal Challenge
The legal challenge center on disputed assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in the state of Tennessee.
Terms of Release
The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
This decision marks a significant turn in a complex immigration case featuring allegations of wrongful detention and disputed gang associations.
